QuickStream AI public website terms
1. About these Terms
These Terms of Use govern access to and use of the QuickStream AI website at quickstream.ai and related public-facing pages (the “Website”). The Website is operated by QuickStream AI, an S corporation (“QuickStream,” “we,” “us,” or “our”).
By using the Website, you agree to these Terms. If you do not agree, do not use the Website. A separate written order form or VIBECAST Platform Customer Agreement governs paid platform services and controls if it conflicts with these Website Terms.
These Terms do not serve as the terms between a VIBECAST customer and that customer’s viewers or subscribers. Each customer must publish appropriate terms and privacy notices for its own branded service.
2. Website information and inquiries
We provide information about QuickStream’s streaming and media services, including VIBECAST, a white-label streaming service for web and supported mobile or connected-TV applications, and VIBEFAST, a fast-channel offering where available under a separate plan or order form.
AI features are available through prepaid credit packs. Credit usage, pack options, and any applicable prices are shown before purchase and before an AI job is submitted. The VIBECAST Platform Customer Agreement explains how credits are used.
Website descriptions, launch estimates, feature lists, examples, and pricing information are general information only. Features, availability, device support, app-store review, integrations, and launch timing can depend on the selected plan, customer materials, third-party providers, and technical review. Binding scope, fees, delivery dates, and service commitments must be stated in a signed order form or agreement.
Submitting a contact form does not create a customer relationship or guarantee acceptance of an order. Please do not send payment-card details, government ID numbers, health information, or other highly sensitive information through a general contact form.
3. Permitted use
You may use the Website for lawful, personal or business informational purposes. You agree not to:
- break, test, probe, or bypass Website security, access controls, or rate limits;
- use bots, scraping, or automated means to collect Website content except as allowed by law or with our written permission;
- introduce malware, interfere with another person’s use, or disrupt the Website or its infrastructure;
- misrepresent your identity or affiliation, submit unlawful or infringing material, or use the Website to violate another person’s rights; or
- use Website materials to build or market a competing service in a way that violates applicable law or our intellectual-property rights.
4. Intellectual property
The Website and its text, graphics, logos, product names, software, and other materials are owned by QuickStream or its licensors and are protected by applicable intellectual-property laws. QuickStream and VIBECAST are names and marks used by QuickStream; no ownership rights are transferred to you.
We grant you a limited, revocable, non-exclusive, non-transferable permission to view and print Website materials for your own lawful, informational use. You may not copy, modify, distribute, publicly display, create derivative works from, or commercially exploit Website materials without our prior written permission, except where applicable law permits.
5. Submissions and feedback
If you send us suggestions, comments, or feedback, you grant QuickStream a non-exclusive, worldwide, royalty-free right to use and adapt that feedback to improve or promote our services, without obligation to you. This does not transfer ownership of your confidential information or content. Do not submit confidential material unless we have agreed in writing to protect it.
6. Third-party services and links
The Website or a QuickStream service may link to or rely on third-party services, including hosting, app stores, payment processors, analytics, or content delivery services. Those providers operate under their own terms and privacy notices. QuickStream does not control third-party sites or services and is not responsible for their content, availability, or practices. Any integrations used for a customer’s service will be described in the applicable order form, privacy disclosures, or service documentation as appropriate.
7. Privacy
Our collection and use of information through the Website and our services are described in the QuickStream Privacy Policy. The Privacy Policy is incorporated into these Terms by reference. Customers using VIBECAST to operate their own branded streaming services have separate responsibilities for their viewers’ information; see the VIBECAST Platform Customer Agreement and the customer’s own privacy notice.
8. Disclaimers
To the extent permitted by law, the Website and its materials are provided “as is” and “as available.” QuickStream disclaims implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free access, that Website information is complete or current, or that a particular service, device, app-store submission, or launch date will be available or approved.
For VIBECAST or VIBEFAST services, customers retain control of the videos and other materials they submit or distribute. QuickStream does not create, select, endorse, or independently verify customer content, and, to the extent permitted by law, is not responsible for that content or claims arising from its publication or distribution. The customer is responsible for the content, its accuracy and legality, and obtaining all rights and permissions. The signed VIBECAST Platform Customer Agreement governs paid services and any applicable indemnity and liability limits.
Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
9. Limitation of liability
To the extent permitted by law, QuickStream will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost revenue, lost data, or business interruption arising from or related to your use of the Website. QuickStream’s total liability for claims arising solely from use of the Website will be limited to the fullest extent permitted by law. This limitation does not apply where prohibited by law or to liability that cannot lawfully be limited.
A paid customer’s remedies and liability limits for platform services are governed by that customer’s signed agreement or order form.
10. Indemnification
To the extent permitted by law, you agree to defend and indemnify QuickStream and its officers, employees, and agents from third-party claims and reasonable costs arising from your unlawful use of the Website, your material breach of these Terms, or your infringement of another person’s rights. QuickStream will provide reasonable notice of a covered claim and may participate in its defense. This section does not require indemnification to the extent a claim results from QuickStream’s own negligence, willful misconduct, or breach of law.
11. Suspension, changes, and governing law
We may suspend or restrict access to the Website when reasonably necessary to protect the Website, users, or our legal rights, or to address unlawful or abusive activity. We may change these Terms by posting a revised version and updating the effective date. Material changes will be handled as required by applicable law.
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any claim concerning these Website Terms will be brought in the state or federal courts located in Brevard County, Florida, unless applicable law requires another forum. You and QuickStream consent to that venue, subject to nonwaivable consumer rights.
12. General and contact
If a provision is unenforceable, the remaining provisions remain effective. These Terms do not create an agency, partnership, or employment relationship. Our failure to enforce a provision is not a waiver. These Terms and the Privacy Policy are the complete agreement concerning Website use, except that a signed customer agreement governs paid services.
